Section 27 grants everyone the right to access to health care services, including reproductive health care. Under this section, no one may be refused emergency medical treatment.
This does not require the state to give everyone the best available health care immediately. It does require the state to take steps to ensure that, over time, more and more people have better access to health care services. At the very least the state must have a plan on how it will give effect to this right.
The right not to be refused emergency medical treatment prohibits private hospitals from turning away patients whose life is in danger, regardless of their ability to pay.
